TRAVEL SERVICES AGREEMENT & LIABILITY DISCLAIMER
SERENISEA TRAVEL
Please read this Travel Service Agreement and Liability Disclaimer (“Agreement”) carefully before booking any travel services with Serenisea Travel. By booking an itinerary, purchasing a flight, securing a hotel accommodation, reserving transport, arranging an excursion, or utilizing any other service through Serenisea Travel (whether in person at our offices or online via our digital platforms), you (“Client,” “Traveler,” “you”) explicitly agree to the terms and conditions outlined below.
1. ROLE AS AN INTERMEDIARY / THIRD-PARTY SUPPLIERS
Serenisea Travel acts strictly as an agent and intermediary for independent third-party travel suppliers. These suppliers include, but are not limited to:
- Transportation Providers: Airlines, boat transfers, rail lines, and ground transportation companies.
- Accommodations: Hotels, resorts, guest houses, homestays, and private villas.
- Activity Operators: Tour guides, island excursion operators, water-sports centers, and scuba diving centers.
- Insurance Companies: Third-party travel insurance providers.
Serenisea Travel does not own, manage, control, or operate any of these third-party suppliers. All bookings are subject to the terms, conditions, tariffs, rules, and cancellation policies imposed by each respective supplier.
2. LIMITATION OF LIABILITY
Because Serenisea Travel does not control the direct operations of third-party suppliers, you agree that Serenisea Travel is not liable for:
- Service Failures: Any acts, omissions, negligence, or breaches of contract by any third-party supplier.
- Financial Loss: Financial insolvency, bankruptcy, or sudden cessation of operations by any supplier.
- Disruptions & Delays: Schedule changes, missed connections, flight cancelations, or mechanical breakdowns.
- Personal Harm: Property damage, personal injury, illness, emotional distress, or wrongful death occurring during, before, or after travel services, including inherent risks associated with adventure sports like scuba diving and open-water excursions.
3. VOLUNTARY PARTICIPATION IN HIGH-RISK ACTIVITIES
By booking high-risk recreational activities through Serenisea Travel (including, but not limited to, open-water excursions, boat transfers, and scuba diving), you explicitly acknowledge that these activities carry inherent risks of severe physical injury, decompression sickness, and marine hazards.
- You certify that you (and any dependents under your booking) are medically fit to participate.
- You assume full responsibility for complying with safety briefings, equipment checks, and certification verifications required by direct operators.
- Serenisea Travel acts solely to facilitate the booking of these activities and holds zero liability for training, equipment failures, or underwater accidents.
4. FORCE MAJEURE
Serenisea Travel shall not be held liable, nor be deemed in breach of contract, for any delay, modification, or cancellation of itineraries resulting from a Force Majeure Event. This includes, but is not limited to:
- Severe weather, tropical storms, monsoons, and natural disasters.
- Acts of God, pandemics, epidemics, or widespread public health emergencies.
- Strikes, labor disputes, civil unrest, war, terrorism, or government-imposed travel restrictions/border closures.
Any refunds or credits resulting from a Force Majeure Event are subject strictly to the policies of the third-party suppliers, not Serenisea Travel.
5. PASSPORTS, VISAS, AND DOCUMENTATION
It is the sole responsibility of the Traveler to research, obtain, and verify all necessary entry requirements for their destination. This includes:
- Passports: Ensuring passports are valid for at least six (6) months beyond the intended return date.
- Visas: Securing valid tourist, business, or transit visas.
- Health Requirements: Completing necessary health declarations, vaccinations, or medical screenings.
Serenisea Travel provides general destination guidelines as a courtesy, but accurate compliance remains entirely your responsibility. Entry into any country or boarding of any vehicle can be denied by border authorities or transit crew; Serenisea Travel accepts no liability if you are refused entry or boarding due to documentation failures.
6. MANDATORY & STRONGLY RECOMMENDED TRAVEL INSURANCE
Serenisea Travel strongly recommends—and for certain custom itineraries or high-risk activities, may require—the purchase of comprehensive travel insurance.
- Standard bookings do not automatically include insurance unless explicitly itemized and purchased as a separate third-party line item.
- It is your responsibility to ensure your policy covers trip cancellation, trip interruption, medical emergencies, emergency medical evacuation, and specific adventure sport riders (such as scuba diving insurance via providers like DAN or equivalent).
- Serenisea Travel is not responsible for any insurance claim denials made by the underwriting company.
7. PRICE CHANGES AND ITINERARY MODIFICATIONS
All rates, tariffs, and quotes provided by Serenisea Travel are subject to change without prior notice until final payment is successfully processed and tickets/vouchers are formally issued by the supplier. Prices may fluctuate due to fuel surcharges, currency exchange variations, government tax adjustments, or airline fare class availability.
8. GOVERNING LAW & SEVERABILITY
This Agreement shall be governed by and construed in accordance with the laws of the Maldives in which Serenisea Travel is legally registered. If any provision of this disclaimer is found to be unlawful, void, or unenforceable, that specific provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
